Neighborhood Problems

3 commercial businesses operating in the neighborhood

3-5 dogs running loose, emptying trash cans, and barking all night

Dogs nipping and biting residents walking in the neighborhood

Speeding drivers, talking on cell phones

Speeding drivers, talking on cell phones, and ignoring stop signs

Shooting guns (hunting ? ) in back yards, next to neighbors' children and pets

More than 6 unlicensed ( and uninsured ) motorbikes ,dirt bikes, ATV's and go-carts

speeding 50 mph+  thru neighborhood and into neighbor's property

Wood burning furnace, improperly installed and operated, polluting the neighborhood

Loud yelling, screaming, fighting, loud music, car racing after midnight

Garbage and toxic chemicals being buried in backyards, polluting water supply

Deer, groundhogs, rabbits, bobcat, raccoon, fox, skunk, crows

Renting out rooms to boarders

4 families have moved because of neighborhood problems ( unenforced covenants )

One homeowner is unable to sell their house because of  neighbor's pollution

Homeowner's Association refuses to accept any responsibility for neighborhood compliance

 

 

 

Neighborhood Activities

Drug dealing and usage

Storage and sale of stolen property

Vandalism and destruction of neighbor's private property

Reckless and Drunken driving

Child neglect, endangerment, and abuse

Animal neglect, endangerment, and abuse

Operating unlicensed and uninsured motor vehicles

Impersonating a police officer

Welfare fraud

Tax evasion and fraud

Insurance fraud

 

 

 

 

Reasons NOT to feed the deer

 

    1.     Most of the deer that visit the neighborhood ( especially the fawns),  get killed by the cars on Rt 480.

 

2.     8 dogs and 5 people in the neighborhood have been infected by Lyme Disease within the past 3 years.

 

3.     The deer are getting poisoned by the fertilizers, herbicides, and fungicides from gardens and lawns.

 

4.     Feeding them in the neighborhood draws them away from their naturally safe environment.

 

5.      Drawing them into the community is only providing entertaining targets for the illegal neighborhood “hunters”.

 

6.     There were at least 4 fawns born in the neighborhood this summer. All are now dead. Each year the number

is increasing because of the extra food being left for them.

 

7.     Gardens, lawns, and small trees are being damaged by the deer traffic.

 

8.     The constant deer traffic late at night keeps all the neighborhood dogs that are left outside barking all night.

 

While the intentions of the people that feed these deer are well meaning and generous, the results are actually

killing the deer and endangering the neighborhood, as well as traffic on Rt. 480.

 

Open letter to all residents

 

            After the last meeting, it has become clear that is it long past due to dissolve

the Homeowners Association. The only points of interest were:

a.       Spending $1000.00 of “excess funds” for a single tree replacement

b.      Petitioning for our own neighborhood traffic light

c.       Sanctioning deer hunting in our development.

d.      Attaching liens to residents property

 

For eight years now, there has been a complete lack of any interest, except to disobey the covenants,

from the majority of our development. More than 25% of the residents

have voiced an open defiance to any compliance to the  contracts they agreed to.

More than 50% of the residents simply choose not to participate in any activity

relating to maintaining a better neighborhood. As a result, we are living in a development with:

3 Standalone, occupied apartments

3 more residents are planning to sell their homes, but can’t because of their neighbor’s eyesores and distracting properties.

 

Since, not a single covenant has ever been enforced, it is no longer possible to even

begin to “clean-up” these problems. Any attempt to enforce, even one of the covenants,

especially  attaching liens on homeowner’s property,

will certainly result in  legal and court battles that will deplete the financial reserves of

HOA and further obligate the remaining residents. The only other possibility is to

have a unanimous vote supporting a new, revised set of covenants. Given the open

opposition by many of our residents, this also is far from realistic. It is now only a matter

of time until somebody enlists the aid of an attorney, begins to empty the remaining

funds of the HOA, and start litigation on supporting residents.

We no longer have any reason to trust in the “decisions and judgments” made by the

default HOA and will not assume any further responsibility for the development’s

inability to maintain  an effective Home Owner’s Association.
